2017 Overview

It has been a year of uncertainty with Brexit negotiations, a disastrous general election for Theresa May, whose plan to increase her slim parliamentary majority backfired on her losing her majority. We also saw North Korea testing further nuclear missiles causing unrest across the world and Catalonia’s fight for independence. These were a few of the political events that caused tremors across financial markets.

Preparing for GDPR and MiFID II were and continue to be the main areas of concern moving into 2018, with many who are under prepared for these new regulations.

Retail branch closures grab the headlines reaching over 700 across the big five banks with RBS and Lloyds Bank leading the numbers in closures. Key FCA fines for 2017 were Meryll Lynch for breaches of transaction reporting under EMIR resulting in a £34m fine and Deutsche Bank fined £163m for their lack of controls for AML.

Last but not least, Bitcoin – whether a bubble or not, it has recieved the attention of the banks and the press.

Financial events to come in 2018

The key regulations that come into place:

  • IFRS 9 - 1st January
  • MiFID II - 3rd January
  • GDPR - 25th May
  • Final rules for SMCR during 2018

Key areas where financial institutions will be focusing on in 2018 have been identified as the following:

Meeting regulatory deadlines

The key focus will be on ensuring that everything planned in 2017 and implemented in 2018, towards deadlines, will continue to be the biggest headaches for banks and investment management firms. 2018 will be a year for remediation work to prevent future potential heavy fines.

Brexit

It is a year for further uncertainty on both regulation and political development, where firms will continue planning for their exit from the EU. Frankfurt, Paris and Dublin will be the hot areas for firms, this is where they will be relocating and growing their operations.

Who will be moving where:

Frankfurt: Deutsche Bank, Nomura, Morgan Stanley, Goldman Sachs and Standard Chartered

Dublin: JP Morgan, BAML and Barclays

Paris: HSBC

Other institutions are yet to make anything public about their decisions.

Data privacy

After GDPR, ongoing data concerns of record management, the use of personal and customer data will be under scrutiny from regulators who will keep an eagles eye over firms. Subject Access Requests (SAR) will be the largest growing area in 2018 when GDPR comes into place. The regulation has tight deadlines and large amounts of legality around what can be kept back to protect the company and its staff.

Cyber security

With the evolution of technology, every company is not only under threat from financial loss from cyber attacks but they also need to take into account the backlash from reputation damage as well as data breach fines. For 2018, regulators should start to outline and introduce new priorities for cyber security and consolidate what firms need to do to prevent and prepare for cyber threats.

Customer vulnerability

A customer vulnerability paper was completed by the FCA in 2015 and it highlighted many areas where banks need to review their products and services to meet the requirements of vulnerable customers.

• Policy
• Products and Services
• Systems

As a whole the message from head office is not implemented into the front line due to poor communication and training. What a customer should be able to do (the do's and don'ts) is not always advised correctly by front line staff. Policies need to be more flexible and common sense needs to prevail when dealing with vulnerable customers.

Products and services are built and designed for the majority. The closure of branches makes it very difficult for those who need to speak to people in order to communicate with a bank. Currently there are too many phone options that divert back to an automated option.

Systems need to be aligned to each other in order for information to be communicated across the group holding company. For example, products trade under different names and brands but belong to the same group. A customer therefore should only need to inform of bereavement once for every product that the deceased had under that group and not have to be passed from pillar to post, informing the company multiple times.

Open banking

The CMA (Competition and Markets Authority) published a report in 2016 after their investigation, discussing how they wanted a more competitive market between challenger banks and the larger institutions, as they
found a huge amount of customers overpaying for certain products and services.

Their solution would be to build a platform where nine of the largest personal and business current account providers; Allied Irish Bank, Bank of Ireland, Barclays, Danske, HSBC, Lloyds Banking Group, Nationwide, RBS Group and Santander would all share data with each other. This including FinTechs and challenger banks.

According to the above, data will be shared between institutions in a secured and regulated format and used to let the consumer understand areas where they can get a better deal. This will go live aligned with PSD 2 on the 13th January 2018.

What does recruitment look like in 2018?

The key areas for recruitment in the operations, financial crime and compliance markets will be:

MiFID II, where transaction reporting and data analysis will be the growing areas, ensuring their reports are accurate for the FCA. There will also be remediation projects to correct inaccurate reporting.

Conduct risk will grow, especially for areas concerning customer vulnerability, they will work with policy teams as well as technology and change within retail banking.

Court production orders staffing will be required on the back of government enforcing that banks check the illegal immigrants that may have overstayed their visa.

Data privacy will continue to be a highly required skill set through attrition and growing departments to deal with Subject Access Requests rather than outsourcing to consultancies and law firms.

Cyber security will continue to grow as every bank will be under constant threat and attack. This will not only require technical roles but also advisory and operational roles such as incident managers and cyber risk analysts.

Financial crime operations will grow aligned with the open banking era and the growth of FinTech roles. The above are growth areas where there will be a large quantity of attrition roles within compliance, financial crime advisory and assurance.

True, a few sectors have done well under lockdown conditions but they have been the exception. It has been suggested that by the time this crisis is over, it could, through the destruction of the economy, cause much more harm to the financial system than the 2007 financial crisis, with talk of a V-shape recovery becoming muted. The future is somewhat unknown, and with no vaccine, the virus will continue to change the world we know.The financial sectorOne particular sector which has weathered the storm is banks and other financial intermediaries. They did this by being quick to react and adjust to the new business environment. An environment that requires more attention to liquidity management, conducting business over a long distance, and offering more time and support to their clients. However, the real test will come when the debt moratorium ends. Banks will need to have a clear picture of the outlook of their clients and their new risk profile. " Brexit in the backgroundThere is also no forgetting Brexit, rearing its head in the background of the pandemic. While we wait for a negotiated deal, the outlook is still concerning, as things will not be the same for most businesses moving forward. A new normal and a new kind of relationship with the EU requires a full-scale reassessment of risk. Banks and other financial intermediaries will need to upgrade their risk management systems, just like they did post the 2007 financial crisis. Like before, banks that stay ahead of the game will emerge as clear winners. Safeguarding for the futureRisk - when the ceiling has been lowered on the revenue front, it makes sense for banks to focus their attention on risk, and to put in more efforts to minimise foreseeable loss. Among other things, banks will want to recalibrate their credit risk models, taking into account the varied impact of Covid on all the economic sectors.Credit quality - financial institutions will need to reassess the credit quality of their clients after they emerge from the crisis; paying particular attention to those in sectors that had been more exposed to the fall out. New data and assumptions will have to be incorporated into the model in order to determine EBITDA, free cash flow and costs.Technology - This will, of course, play an important role in risk management. Banks will employ new technologies to help manage operational risk, credit risk as well as market risk. If the 2007 crisis is any indication of things to come, a lot of hard work will have to be put into the management of credit and operational risks, employing new technologies to monitor banking operations, review data and reconfigure risk models.Talent insightFor now and for a long time to come, talented risk managers and professionals are what banks will continually need - people with the right set of skills and experience. Unfortunately, the talent pool of risk managers has not been expanding in line with the new demand.Over the past decade as regulatory demands were on the rise, becoming increasingly more complex, no meaningful efforts were made to attract more talented people into the field of risk management. This has led to a shortage of skilled risk managers even before the emergence of the pandemic. 2020 has been an unexpected year across the world, and it has been crucial to monitor and deal with all the effects of the Covid pandemic in business and in our personal lives. Amidst this crisis we have also had the uncertainty surrounding Brexit looming over us, which has left many businesses trying to deal with the immediate challenges to society and the economy at large. The effects of both have been felt, and we can see this within the jobs market.   As experts within specialist markets we have been privy to fluctuations within specific industries. Below are some of our observations across the market.Custom and duties tax specialists We have seen an increase in activity and growth across custom and duties tax specialists for large import/export FTSE businesses. Particularly businesses are looking for candidates on an interim basis to make sure effective processes and controls are implemented. This is an evolving space and once we have further clarity we expect demand to increase. In the last 6 months, we’ve seen an increase in recruitment activity from businesses in industries such as food manufacturing and FMCG that have had an increased demand for their products on the back of lockdown. In addition to this, businesses that do a significant amount of importing and exporting see customs and duty as a key area of focus with Brexit looming, and we have advised and recruited for several clients who have required specialist knowledge. This is a niche skill set that can be provided at premium rates by consultancy firms, but there is a recent trend to bring this expertise in house. The cost of doing this would be in the region of £40-50k for a perm hire and c£250 per day for a temp hire - watch this space if you're a candidate within this market.  Audit and riskAudit and risk have also experienced an increase in resource on both the temporary and permanent markets. As organisations seek to learn effectiveness lessons from the crisis they require resource to conduct and undertake Covid specific reviews. In addition, the offering of flexible working arrangements also provides a great opportunity to test network capabilities as well as controls across user access, disaster recovery, business continuity, as well as high level IT controls testing to ensure remote working does not compromise the risk appetite of the business. Start ups Over the past 6-12 months we have also undertaken a number of start up engagements, helping businesses recruit permanent heads of department to develop strategy internally. Not something someone wants to see coming from the PRA (Prudential Regulation Authority), however, this is the letter that went out to the CEOs of banking institutions in the UK recently. In essence, whilst it wasn’t targeting specific banks, it was more of a general piece to inform banks that the PRA are investing pretty heavily on technology, meaning that they plan to make it easier to look at data at a more granular level. In the future this could mean that they rely less on submissions and more on their own teams to analyse and interpret the true status of the banks’ liquidity and capital positions. Some organisations took this with a pinch of salt, while others have used it as a catalyst to recruit – and we’ve definitely seen an increase in recruitment within regulatory reporting. Organisations are pulling the trigger to recruit as a way to safeguard themselves against potential PRA action, particularly if the business is understaffed, or could do with an extra experienced head to ensure there are adequate controls and processes in place. Let’s take a look back to 2019? The last couple of years saw the market tighten, in particular to lower remuneration packages being offered to candidates compared to 2015 and 2016. Since the introduction of CoRep, the only other change was PRA110, but rather than paying over-the-odds salaries for specialists, the implementation was largely done taken in house. At the start of the year we saw an over-supply of contractors in the market, the majority working in narrow roles, for example only on RWA. With organisations looking for accountants that could complete the full suite of returns, contractors subsequently found themselves out of the market for a while, being asked to lower their rates, and clients not proceeding and wanting to hold out. Those in permanent roles were in a better position, however in some cases there wasn’t enough of a salary increase to warrant a move, creating a situation where roles were being advertised for a long time, and clients were then forced to compromise on what they sought from the beginning.  What should your recruitment strategy be for 2020? In the summer of 2018 we predicted that regulatory accountants with skills like VBA and SQL (and now Python) would become even more valuable in future for both organisations and talent. Even though the RegTech market is dominated by the likes of Vermeg (formerly Lombard Risk), Axiom, Wolters Kluwer and K-Helix, a lot of organisations we work with are still heavily reliant on Excel and producing these returns manually. We feel our predictions are coming true, with regulatory accountants who have excellent working knowledge of SQL/VBA/Python will soon find themselves in a stronger position (irrespective of their qualifications), as they are able to automate and streamline the whole process for producing and submitting regulatory returns. Where the PRA will apply pressure on banks to reduce their reliance on Excel, bringing in these candidates can better bridge the gap between the RegTech products and their in-house systems.  They can potentially safeguard the Bank from being a served S.166. We also cannot ignore the value of recruiting newly qualified ACAs from the Top 6 firms, as they understand the importance of controls and processes, and we know that’s what the PRA will also look at. Candidates with the full breadth of experience producing and submitting the full suite of CoRep returns are already in short supply, so the question is, do you continue to hang around for that perfect candidate to do a BAU role or do you accept that the landscape is changing and you’ll need to start future-proofing yourselves from potential PRA action?
